Expanding Mediation to Criminal Cases

Following a recent trend amongst other courts, the Supreme Court of Kansas just announced the inception of an advisory group tasked with creating criminal mediation rules.

The group is tasked with studying the best practices of criminal mediation throughout the country.  Such will include analysis of applicable rules, as well.  The goal is to create a systemized criminal mediation process that will aid in the speedy resolution of cases while offloading some of the burden that criminal courts carry.

This is not new in Kansas as the process – on an informal basis – dates back over a decade.

It is only a matter of time before this practice spreads across the country.
